Real Estate Services

For over fifteen years we have been trusted advisors on all manner of real estate transactions, from buying, selling, and refinancing both residential and commercial properties, to land assembly, quieting of titles, and development work. Our services include negotiating and preparing purchase and sale agreements (including condominium documents), conveyancing, financing, leasing, and general advice on all aspects of buying, selling, and owning property, including resolution of title issues and boundary disputes.

Real Estate Development

Our lawyers have significant experience in real estate development, having worked for a range of real estate clients over the years, from the “one and done” custom residential development to the multi-year residential subdivision client. We have seen it all.

Our firm is actively involved with the Newfoundland and Labrador chapter of the Canadian Home Builders Association (CHBA), and the Newfoundland and Labrador Construction Association (NLCA). In addition to our long-standing membership with these organizations, we have also written numerous articles and presented at various seminars for these organizations, as well as other organizations directly involved in the industry such as the Newfoundland and Labrador Association of Realtors (NLAR).

Due to our longstanding involvement in the industry, we possess an intimate knowledge of the legal issues facing land developers, contractors and the service professionals who support them.

We offer a host of services to our clients, including advising on land assembly and title issues, negotiating, and preparing agreements of purchase & sale, establishing condominium corporations, conveyancing, advice on development agreements, municipal service agreements, construction contracts and financing agreements.

If required, we also offer advice on land use by-laws, municipal planning strategies, and related administrative and litigation support in situations where developers find themselves in a dispute with their governing provincial or municipal authority.

Construction Disputes

Over the years we have acted as trusted advisors to developers, contractors, engineers, architects, and project managers on all manner of construction disputes and construction related litigation. We have significant experience with mechanics liens matters, expropriations, contract disputes, building defect issues, and crisis management.

We have a solid reputation for our abilities in the Courtroom and in dealing with complicated construction issues and expert witness testimony. Our past cases have seen us represent clients on a range of matters from small residential building disputes to multi-million-dollar construction projects.

For our commercial and industrial developer clients, we routinely work side by side with their in-house legal team and welcome the opportunity to collaborate with our in-house colleagues on all manner of construction issues and disputes.
